That's not a freaking mistake! That's a freaking moron that needs his ass beat. As a firefighter I see this crap all the time and so many times only the victim is truly hurt....I make sure to not be gentle with my medical care to the drunk, and if my wife is ever hurt or worse by a drunk, I swear I will kill them on the spot, and my KPD officers will look the other way!! Stupid ass
I've been falsely arrested for DUI. I musta looked like the dude that took the cops lunch money in 8th grade or something cause I blew 0 on the breathalyzer and passed all the sobriety tests. He said my eyes 'ticked' during the pen test. Purely subjective. I volunteered to do a blood test. Nothing.
I still went to jail for the night and the scumbag cop kept my handgun for 6 months before returning it. However, the judge never let it get to court due to the laughable amount of "evidence."
So yes, it does happen.

Only because he refused to submit to one. Which is an automatic conviction.
