Well, both those states already have an implied consent law for the breathalyzers, so I would disagree.

The blood test is the more reliable test with a far lower false positive rate, which is why it's becoming the standard. Too many legal challenges of breathalyzers.
 
I guess EA can get one his attorney's that advertises with his station. gonna be an interesting Monday morning. I wonder if he'll show up?

Well it's not testing someone till they fail in something to charge them.

I can refuse a breathalyzer. I lose my license for 6 months. Much better than a DUI. Not to mention they aren't testing us for drugs on the side of the road.

You're missing the point. YOU AGREE to the blood test when YOU apply for the driver's license. It's on the form. You sign that you understand it.

But my question for you is this. If the officer feels you have been drinking and you refuse to be tested, what is he or she supposed to do? Let you go?

What's the difference? It's still driving under the influence, and it is still illegal.
 
I can tell you love little Eric...and my original post said if ANY drunk ever ........I would whip there ass and KPD would turn there back.....and I'm a bad guy...a freaking drunk would've killed my loved one.everyone was wanting Gary Christian to get a hold of those thugs that killed his daughter, what's the freaking difference here? You're not judge, jury, and executioner. You and fellow LEO's would do good to remember that.

Lol that's why I'm asking you. What should be done? You don't seem to know. You seem to have a billion problems with DUI stops, but 0 problems with DUI fatalities.

How does one protect other drivers, along with innocent suspects? What's the answer? Because personally I like the current system. The only thing I would change is that I would increase the penalties for refusal to submit to a blood test. The blood test takes objectivity out of the equation.

Your missing the point. I live in arkansas. There is no consent to blood work. Hell I hit a road block once. Hadn't been drinking. But the cop wanted me to blow. I declined. Told him we will go down to the hospital for blood work. He told me have a nice day.

If I decline. Fine take me to jail. I will go to court. Prove my case.

But the cop better be right. Because I may go get proof of my own. Then it's unlawful detainment and I'm getting a check.

Just because they are cops don't mean they can walk all over me or you. I respect the law. Problem is. They don't know the law.

You can refuse the blood test. That's a violation of the implied consent law, and you lose your license for a year, just like on a DUI.

The difference is, if you plead guilty to the DUI, you can apply for a restricted license for the year to drive to and from work or with an interlock device. With an implied consent violation, you cannot apply for a restricted license.

I'm not sure where you're getting the side of the road thing. The law in Tennessee says it has to be done in a hospital or medical facility by a medical professional. They do the Knox County tests at UT hospital during the week and at the medical ward of the jail on weekends.

30 days was not mentioned earlier, at least not that I saw. But I have no problem with holding a DUI suspect who refuses to submit to any form of testing, for up to 24 hours.

I am sorry, I misspoke, there is no 30 days jail time in TN. read the link but here is what you get if you do not deal with the officer, even if you are stone cold sober and on the way to the interview for the job you have always wanted, the birth of your child, or your wedding - it doesnt matter.

Once you are arrested, the officer should tell you that your license will be suspended for your refusal.

Later, if you are also convicted of a DUI – even without evidence of a chemical test – you will not be allowed to drive without installing an ignition interlock device on your car.

Seems wrong to me. Refusal to have your body invaded by police, completely sober = suspension of drivers license.
