Lol that's why I'm asking you. What should be done? You don't seem to know. You seem to have a billion problems with DUI stops, but 0 problems with DUI fatalities.

How does one protect other drivers, along with innocent suspects? What's the answer? Because personally I like the current system. The only thing I would change is that I would increase the penalties for refusal to submit to a blood test. The blood test takes objectivity out of the equation.

So you think I should be allowed to drive under the influence of crack? Heroin? meth? oxy?

What's the difference? It's still driving under the influence, and it is still illegal.

Marijuana can stay in your blood for 12-18 hours. I don't know if you've ever partaken, but there's no way somebody's still "under the influence" 18 hrs after they used pot.
 
You can refuse the blood test. That's a violation of the implied consent law, and you lose your license for a year, just like on a DUI.

The difference is, if you plead guilty to the DUI, you can apply for a restricted license for the year to drive to and from work or with an interlock device. With an implied consent violation, you cannot apply for a restricted license.

I'm not sure where you're getting the side of the road thing. The law in Tennessee says it has to be done in a hospital or medical facility by a medical professional. They do the Knox County tests at UT hospital during the week and at the medical ward of the jail on weekends.

I am sorry, I misspoke, there is no 30 days jail time in TN. read the link but here is what you get if you do not deal with the officer, even if you are stone cold sober and on the way to the interview for the job you have always wanted, the birth of your child, or your wedding - it doesnt matter.

Once you are arrested, the officer should tell you that your license will be suspended for your refusal.

Later, if you are also convicted of a DUI – even without evidence of a chemical test – you will not be allowed to drive without installing an ignition interlock device on your car.

Seems wrong to me. Refusal to have your body invaded by police, completely sober = suspension of drivers license.

how do you propose we prove someone committed a DUI?

If someone's blood is tested on the roadside, their attorney should have the case dismissed. That's not the law. Has to be done by a licensed medical professional in a licensed medical facility.

That's fine. I would agree then that the amount of marijuana required, should be enough to prove that you were under the influence at that time. As opposed to the current limit of 0. But that doesn't mean we should get rid of blood testing.

I can refuse a breathalyzer. I lose my license for 6 months. Much better than a DUI. Not to mention they aren't testing us for drugs on the side of the road.

That still floors me

you still are charged with a DUI. you have a trail. how do you people honestly think, very liberal use of the word, that your refusal of a breathalyzer means you dont get charged with a DUI?

Nah, I like only working 9-10 days a month. And women love firefighters. .especially the ones with muscle and about 12% BF.... it is what it is, thought the world would agree, Liberals

Since this is what you apparently think is important about being a firefighter, it's small wonder you have no professionalism about your job. You're a disgrace.

That's not accurate. Pulled over in Knox County by the KPD, his blood would have been drawn at UT hospital or at the detention facility medical ward prior to booking.

Because with out evidence it can't be proved. Ill take the lessor of two evils if you will.
