If he did in fact drink and drive I hope he gets help and hope he is shown no favoritisms.

I'm really not trolling here. I see blood, breath, or urine testing as the only way to prove either guilt or innocence for a DUI.

He seems to believe the only time you should be charged with a DUI is after you wreck. That's outrageous.
 
Inability to maintain your lane. Slurred speech. Smell of alcohol coming from the vehicle. I would consider those reasonable suspicion.

What if they find antibotics in your system you don't have a script for?
 
that is fine but it should be decided in court. there are reasons to refuse, and the person should have to explain them. if the jury or judge does not buy it then they get a DUI. im against this unjust implied consent law

Driving is not a right, its a privilege. That is why you
are licensed by the state of your residence. As I said before, when you sign for your drivers license, you agreed to submit to a BAC if warranted
 
That's fine. I would agree then that the amount of marijuana required, should be enough to prove that you were under the influence at that time. As opposed to the current limit of 0. But that doesn't mean we should get rid of blood testing.

Blood testing is an invasion of your privacy like hair samples.

I can tell you love little Eric...and my original post said if ANY drunk ever ........I would whip there ass and KPD would turn there back.....and I'm a bad guy...a freaking drunk would've killed my loved one.everyone was wanting Gary Christian to get a hold of those thugs that killed his daughter, what's the freaking difference here? Maybe a lot of You drink and drive? ?

Must make you feel like a big man to rough up drunks who have been in accidents. Do you slap elderly people around too? I know of a good nursing home you can check out.

The good news here is that by refusing to take the test, he automatically loses his license for a year. So at least we know he won't be killing himself or anyone else anytime soon, hopefully.

Unless he goes to trial and beats it or pleads to a lesser charge. Your lack of understanding of the law is very impressive!

haha no im much closer to the other two fields. i generally like police though. hated them when i was at UT b/c the KPD didnt care about us and the UTPD were a bunch of young guns who'd storm into anywhere like they owned the place. most police are good people though.
 
the police have to bring a warrant in front of judge to run a DNA test legally. i agree with you, even though im guessing you ignorantly intended the opposite

My only intention is good discussion most of the time. Implied consent law shouldn't exist.

Blood work and urine will show this. It's against the law to take meds or have meds in your possession that aren't prescribed to you.
