Satellites are above the 100 km Karman line and are thus not considered to be violating airspace under international law. 40k feet is clearly defined as part of a nation’s sovereign territory. Good question but the legal aspect is well defined hereSure I'd shoot it down and call it a day but does this reach the level of invasion? Is this really more intrusive than a satellite?
It is still an illegal incursion of sovereign territory. The instrument is immaterial. The action is not. As a matter of fact, the relative pettiness of it makes Biden look even weaker as he can’t even defend his nation against a technology from the 1700sFlying military aircraft over Taiwan is a test. An air balloon with a camera is more like a joke.
