Jaylen McCollough arrested

Do we think McCullough meant for the dude to end up at the bottom of the steps? If we believe the statement of the victim:

1)he was in the wrong apartment, apparently somewhat compromised as far as judgment.
2)he wasn’t assaulted in the apartment but was given the chance to leave.
3)he said something to McCullough and the situation escalated after that.

Let’s just say all that is true which you and I know the truth is usually somewhere in the middle but let’s say his statement is entirely true. At what point do you say hey the victim was in the wrong place and made matters worse by escalating the situation further. Maybe if all that is true McCullough deserves some punishment but there are a range of mitigating circumstances and that’s just if all of the statements of the victim are true.

Wow.... really.

JM's reaction? "What the **** are you doing!! Get out!!"

Darth inVader "You don't have to be a **** about it.... I made a mistake! Sorry a**wipe!! Seriously...."

JM goes outside, more words are exchanged, drunk dip**** ends up at the bottom of the flight missing teeth..... (JM is kind of a big dude compared to most)

And, here we are, bad decisions all around during Bama week.......

Every UT athlete goes through multiple “life skills” seminars where they are taught life lessons. I’m sure at least one is lead by Greg Issacs ( or other UT donor attorney.) During this seminar the athletes are all given the contact info for “friendly” attorneys available 24/7 that if the athlete encounters a legal situation they are to call and not to speak to the police -other than name and ID - until they have counsel present.
This YouTube includes a police officer in law school telling everyone to not say anything to a cop without counsel

So, everyone is saying not to assume what is not in the arrest warrant. There is nothing that says the victim was drunk.

If you have never walk into the wrong building in a complex that all buildings have the same layout, I don't know what to say. If you do not live there but think you know where you are going, it is very easy to go to the wrong room. I've done it sober, but I looked at the number before knocking and left. if you were distracted like most people on their phone it could happen.

Just saying there is assuming on both sides and you guys are going in circles.

If he was as innocent as he says, apologized and everything. Why was there a problem? JM hasn’t been in trouble the whole time he’s been here. And everyone knows how easy it is for players to get in trouble in Knoxville.

I think AJ Johnson’s situation is definitely what can happen. You do remember that don’t you?

I do remember AJ, and that storey was nothing like this. AJ and what happened to Joey Kent are more a like.

I just don’t believe the guy. Did he get punched? Maybe but that doesn’t mean he’s telling the truth about what happened.

Since his account is the only thing we have to go on.

I support the "innocent until proven guilty" line of reasoning. But a senior should know better than to get himself into a situation where he leaves his team without one of its important starters for one of the biggest games in recent memory. Young guys making bad decisions!!!!
 
Only one side of the story is being shared right now and I don't think the Police had the full story from both sides before deciding to charge JM with agravated assault.

I'm no legal professional or anything close to it, but wouldn't it be hard to prove that Jaylen meant to cause this individual serious bodily harm? I understand the guy fell down the stairs, lost consciousness, and a few teeth. But how much of that is of his own doing by being drunk and losing his balance? Is Jaylen supposed to immediatley know he is drunk? How far do the stairs go down? Is this complex known for thieves? Was this guy making threats? etc

I think the better case to make is simple assault on the basis that this was at most, a reckless act by Jaylen, but not an intentional act to cause serious bodily harm. And if it is downgraded to a misdemeanor, I think it would be more likely to settle privately with the guy (pay for his dental work, medical bills, and other damages) on the basis that the misdemeanor charge is thrown out.

JM didn't "get himself" into a situation..... He just mishandled the situation he found himself in.

This seems reasonable based on what has happened to me....

JM decided to go all "I MUST DEFEND THIS HOUSE" even as Darth inVader said "There's no reason to be a **** about it, I made a mistake... get over yourself @ss****"

JM has now been "disrespected".... Follows dumb*** that opened door. Punch ensues..... Darth inVader falls down flight of stairs, loses teeth, cops get involved and here we are.....

During AL week.....

Dude, you or I neither one know JM and it just isn’t right to put all the blame on him when we don’t have both sides of the story. I know that he’s been at school for 4 years and he’s never been in trouble. What makes him decide to just throw caution in the wind on this. It doesn’t add up.

How about being a leeetle bit more forgiving when someone accidentally causes you some anguish.....

Can't do that, though I guess..... forgiving an accidental slight means you're a.... weenie? wuss? not able to put a quarters worth of lead in a head?

In the police report it clearly states that Spencer told police he had been drinking.

Remember Jim Bob Cooter when he once crawled through wrong window and into a girl's room or something like that. Anyone here remember this besides me? I'll Google story in morning see if I can find it as I am headed to bed now.

This is stupid. No one on here knows what happened. Cops made a judgement call, based on them looking into things, and here we are. I know the cops know more then we do. Doesn't mean he's guilty. Doesn't mean he's innocent. 100% means he isn't playing Saturday and this is all a stupid argument
