What constitutes a lesser offense is a known quantity. I imagine judges keep a list since they have to get them all into the instructions.

So nothing is really being “added” per se, it’s just whatever you are charged with comes with a known bevy of lesser included offenses.

So like in Tennessee if you’re charged with first degree murder then second degree murder, voluntary manslaughter, reckless homicide, aggravated assault, and assault will always be lesser included offenses. I’m sure there are others but it’s basically anything where all of the elements are included in the higher charge.

The lesser charges were only added after the prosecution realized they were suffering major Titanic moments and they used the drone video, that there’s a serious issue with, was utilized to get the provocation charges added as jury instructions were being discussed.

The jury requested to see the video. Everyone agreed they will watch it in the courtroom (emptied), but the defense is attempting to keep out the drone footage and limit the jury to seeing each video to only time. The prosecution says they should see it as many times as they like.

There are major issues with that drone video as to the defense having been provided a much lesser quality and size version than what the prosecution has.

Kyle was not old enough to legally carry a handgun which he pointed out to the prosecution who didn’t appear to know anything about gun laws regarding age limits for specific types of firearms.
