New Arizona Immigration Law

only thing i'll add is, if legal hispanics got to prove their legal status when breaking the law, than EVERYBODY should have to prove it.

Make a motion Cash.:salute:

Im for whatever it takes to get them off our streets, out of our election process, and eliminate them from working in a country where the legal citizens pay taxes, and they are exempt.

Are you saying that the courts disallow a legal immigrant from showing positive proof of their legal status?

That's a gem right there. Perhaps you should stick with semantics and red-herrings.

You are your own worst argument.

Based on the provisions of the Bill, it looks like the Bill will essentially require law enforcement officers to take action if someone in custody cannot prove citizenship. Having a valid drivers license or federal identification creates the presumption of citizenship. Granted, I didn't read too deeply into it so I may be way off. But, as I interpret it, I can't say I have a problem with it.

Here is the Summary; Here is the Full Text.

So basically the illegal must commit a second crime,(if not caught crossing the border) and be in custody before the authorities can ask for docs.

Well, they can first question someone based on "reasonable suspicion." But reasonable suspicion cannot be based solely on someone's race, color, or national origin. So, any other evidence can be used (i.e., they get a tip from someone who thinks someone is an illegal).

Sounds logical.

As far as race, color, and national origin.

Color is really the only one of the three that could be determined without questioning or have documentation.

Who doesn't?

yeah, I get that... How does this law change that??

Just seems if there's already probable cause to arrest somebody, what's the point of this law?

"Immigrants unable to produce documents showing they are allowed to be in the U.S. could be arrested, jailed for up to six months and fined $2,500," per that above document...

don't take a stroll without your license now, if that is indeed enough I.D.

exactly. They'd never have an opportunity to get it right. Straight to jail and deportation they'd go.

you're acting like they will be setting up ID stands on corners in south Phoenix. The police don't have the time for that. They weren't even allowed to ask if a person was under suspicion of a crime. Most will be caught during traffic stops while driving with no license, no insurance and a stolen license plate.

It requires police and prosecutors to attempt to determine whether someone in custody is an illegal. It also requires them follow up on the issue by transferring them to ICE officials (immigration customs enforcement). None of this was required before. It does some other things, but those are not very controversial. However, when you actually look at what they are doing, it is much less controversial than has been argued by the media.

1. As far as driving goes, it is illegal to drive without your license in possession at the moment. So, acting like keeping your license on you is a burden is a bit of a stretch.

2. With respect to people not driving, police can't just stop random people on the street on the basis of their race or color. There must be something more than that to create a "reasonable suspicion."
