Bruin- Telling Dooley he will not be retained could be a notice of termination. He has to fulfill his duties to get his buyout. No one really knows though.

Sure it is a notification of termination but the job isn't legally open until the job is publicly open. That is my entire point.
 
Larry has been a very solid poster.

Is it possible the AD is throwing out names of coaches of interest to insiders like Larry to try to slow down all the Gruden talk even though Gruden is the man that will be standing on the sidelines in 2013.

No, I disagree. I don't know about state requirements as I have said before. But the job is open when Dooley is terminated. It doesn't have to be made public for that to happen.

Force guilt? It's funny how you assume my situation way before you know who I am, what I do, what my wife and family contribute. I think open discussion on a forum is healthy for all parties involved. You all take it as a negative because it's not in the ebb and flow of the positivity related to Gruden, signed sealed, delivered. Excuse me for relaying a fact.

Bringing up the possibility of having a deceased son has the appearance of fishing for sympathy.
This is a scumbag move no matter how you look at it.

It's amazing how discussion changes throughout the day...daytime=everyone sober so humorous and lighthearted, mixed in with great info. Nighttime=whiskey time(lol) even more humorous, mixed with aggressive behavior, trolling, name calling and apologies in the A.M. (JMO)

What if the document is written like "In the event that the head coaching position becomes vacant within the next 30 days, both parties agree to...blah blah..". I think that could be legal.
 
I'm so sorry that you might possibly have to change your "avi" but don't let it deter you from name calling me. Again this is a forum for discussion, let's continue it without name calling.

Try to keep an open mind to posters regardless of their situation. Just because someone else's opinion is presented and questions are asked DOES not mean that a deal is DEAD, DISCARDED, DESTROYED. It's the simple nature of humanity. The right to ask questions. Don't take it personal. I don't know what it means when Larry says what he does, but I have a few OPINIONS, SUBJECTIVE INFERENCES on the matter.

Just because UTAD has not issued a statement to the media does NOT mean that a decision hasn't already been made.

It is not Derek's choice to remain in his current job - he doesn't need to know that he is fired for it to be true.

Sure that's all correct but jobs must be publicly open to protect the state from anyone claiming that jobs were filled improperly. A job must be open in order to be filled and that requires it being public.


Some of you need to learn how state law impacts jobs paid by the state

Not really. Years of Cognitive Behavioral Therapy will do wonders. It's quite hypocritical for you to say it's inappropriate for me to bring up something so personal, yet we are talking about a secret MOU that is signed while the HEAD COACH of the Volunteers is still retained? Talk about inappropriate if true. Bad business if that is the case.

Lets use common sense here. Should a state employee be able to hire and fire all his employees without making any of it public??!
 
You are not understanding. A coach would not sign an MOU if he didn't want to take the job. It is not that difficult.

On the plus side many of those documents do indicate that the parties have agreed on the big parts of the contract, and at least Dooley and Sunseri's contracts didn't look particularly complex or demanding so there hopefully wouldn't be much to get tangled up about.

There are still hurdles remaining but if all of this is true then it's still fantastic news.

As stated on here MOUs can be enforceable or not depending on their wording, but whether this one is doesn't really matter IMO.

It indicates both sides have agreed upon a framework for an agreement and an MOU is an attempt to more formalize that agreement.

In short, UT wants Gruden and he's indicated he would like to come based on the terms they've set forth.

Anyone can change their mind and deals do fall apart, but it's generally not in either party's best interest to do so unilaterally due to the bad stigma associated, particularly when it is well-known.

Do you know this to be true? I am simply telling you the mechanics of a fire and hire. Once Dooley is given notice, the job is open.

Thank you to this board for helping me keep my mind off of things......and bear with me but typing this is helping me

I lost an Uncle today to Cancer, he was like a second father to my brother and myself. While I know he is no longer in pain and he is at home now with God. It does not help with the hurting and heartbreak for our family, but we all know he did not pass, he was called "HOME" . During my time alone today or tonight when the wife and kids are asleep I have had this bard to keep me busy, reading, laughing and throwing in a post ever once in a while.

There one more Vol fan in Heaven tonight, I Love You and miss you Uncle RS!!!

Already answered. A lawyer would argue circumstances changed between time Of signature and job opening

And if we all face it, we love this site and team so much because it does allow us to take the focus off of our own life, and invest in something else.

And if we're really honest, the hope of having a good football team is what keeps some of us going. It's why we want Gruden so badly. Just to have hope that something we love will be what we want it to be.

Will mention you and your family in my prayers tonight. Cancer is an ugly thing. But God is great, and when he's all we got, we realize he's all we need.
