Donde goes to Mars to get more candy bars. All of this orchestrated, coordinated, and oooh man it feels nice.
The lawsuit from Tennessee and Virginia, according to a release from the Skrmetti’s office, claims the NCAA is “violating federal antitrust laws with its anticompetitive restrictions on the ability of current and future student-athletes to benefit from their name, image, and likeness (NIL)” and claims those restrictions violate the Sherman Act and “harm current and future student-athletes”
“Student-athletes generate massive revenues for the NCAA, its members, and other constituents in the college sports industry — none of whom would dare accept such anticompetitive restrictions on their ability to negotiate their own rights,” the release states. “Student-athletes shouldn’t be left behind while everyone else profits from their achievements.”
They seriously just put a half loaded revolver to their head and pulled the trigger...it is one of the most monumentally stupid things I have ever seen done by a major entity.This has been in motion for a very long time. The NCAA must feel supremely confident in its position. No one with a brain larger than a pea would think this is a smart move. They themselves are gaslighting institutions whom by their own lack of foresight, have created this issue.
Now they get to pay the piper. What the actual **** were they thinking? They will have multiple lawsuits.
Yup. This exactly. They literally knew/have known this was a potential outcome from day one... And were likeRemember most of us agreeing that the NCAA would be sued for violating anti-trust laws when NIL first started? I'm surprised that even we could see this coming from a mile away and the NCAA didn't have the foresight to tread more carefully. I hope we nuke their ass.
This will end badly for the NCAA. This is not UT vs the NCAA. This is the state of TN and commonwealth of VA, through their state attorney generals, vs the NCAA.
And its filed in the Eastern District of TN federal court. We will get a fair shake at the trial court level. Brilliant move by these AG's and governors to be ready to roll with this so soon after the NCAA leaked their investigation to Pat Forde. Appeal from the trial court is to the 6th Circuit Court of Appeals, which is a conservative leaning court (10 out of 16 are Trump and Bush appointees).
Appeal from the 6th circuit is to the US Supreme Court which of course has a conservative majority. I have to believe our state leaders have had their powder dry, but loaded, for quite some time.
The leadership team of our state and great university have a great game plan in place. Time to execute it and put the NCAA in the place, or out of business.
