This is from a workshop/lecture/whatever you want to call it I went to last week.

They reiterated several times:

- If alcohol is involved, you're pretty much done for.
- You must gain VERBAL consent.

That is just what I heard.

I'd rather not get into this discussion, for the sake of everyone reading this thread.

That is not in the Tennessee Code. It's decent advice. But it's probably more accurate to say if you can't drive then consent is dicey. Not impossible to give, but dicey.

I presented the possible rape situation last night since there are some really good thinkers with great perspectives and backgrounds on here. I have come to respect many of you. I had wrestled with it and had drawn no conclusion. It was pertinent to this thread without being presented as such, as some have surmised. It has happened at least twice in our football program recently; the first with an added complication of multiple alleged offenders.

I feel for all involved, including those in the criminal justice system that both prosecute and defend. We are all impacted by thoughtless, impulsive decisions that can go wrong at any time. Some people even benefit through their jobs from the many stupid actions that occur. Yet, we still make them. The discussion of the deeper, underlying cause will be left for another day in a different thread and a different forum.

Watching Jennings run for a TD yesterday, my first thought was he's fast! My second was can the coaches get him on the field this year in some capacity? RB? WR? Seems a shame to have him sit out this fall as a RS QB.

Some people thought I was crazy, but I said when we signed him that the coaches should take a look at putting him in a situational wildcat package this year. It gets his athleticism on the field, and it gives him confidence at QB. JMO.

The very moment a female takes a sip of alcohol, she is deemed unable to give consent.

This is by law. You didn't need to give this elaborate story. If she drinks, it's considered sexual assault.

And what about the guy? A drunken girl asks a drunken guy to have sex? Both of them aren't under their normal function, but alcohol only protects the female?

Laws can't only run one way, so I'm saying either you made that law up or our country is even more screwed up then I ever thought.

As a criminal defense attorney, I have discussed this with colleagues on multiple occasions. One of the ways that someone can be convicted of rape in TN is without the effective consent by the victim and the defendant knows or has reason to know at the time the victim did not consent. So, what if she first consented but then changed her mind halfway through? If alcohol is involved, then it blurs everything. Alcohol effects memory and clear thinking for both individuals. Frankly, it's kind of a scary definition. I basically rephrased some of your scenario, and there is no good answer.

Here's my take on it: if you think a jury gets it right every time, toe the line. If you think the government screws stuff up sometimes and sends innocent people to jail, stay the hell away from the line. I know which side I come down on.

This is correct. But even if it's decent advice (which is questionable, at least in certain circumstances--e.g., my wife and I couldn't have consummated our wedding night if this advice was followed), it's completely unrealistic advice. I like your rule much better--if you want to hook up with a stranger who is "too drunk to drive," then be careful. They can definitely still consent at the legal limit, though.

But the problem of course is that it's hard to tell how impaired someone is, especially if you yourself are impaired. And the bigger problem, ultimately, is that the other person could be stone cold sober and still accuse you of rape--and even if you're not convicted, you are likely to get branded a rapist, kicked out of school, excoriated on VN, etc.
 
So he's going to end up as a 3rd string wide receiver for Carson Newman? Maybe we should let Jennings develop a little before we determine he can't do it.

I was talking more about his skill set. I think JJ has a better head on his shoulder than Banks did.

My baby girl is struggling today. She's had issues with her breathing since yesterday, which is caused from her heart failure.

I'm breaking into pieces.

They're working on her again.

Haven't stopped praying since your first post. I have two little girls at home and they are my whole world. Can't imagine what you're going through right now.

Sorry to hear that OB.

I can't imagine what you're going through emotionally but stay STRONG. Your little girl is going to need your strength to make a full recovery.

This is the main reason I think Jennings will be right in the thick of the QB race in the next couple of years. He has the ability and the work ethic. It really boils down to whether he can tap into all that potential.

He definitely has athletic ability, but I believe it's too early to say if he has SEC level QB ability. All his passes were behind or worm burners, he didn't really show much. I believe the sooner he makes a position change the better it is for him if he wants to ever start/ make it to the league.
