State of Tennessee Wins the Injunction

Based on what? The NCAA can't touch NIL used in recruiting or transfers. What else are they going to go after coaches and administrators for? Plowman, White, and Heupel for daring to stand up to them?
Don't ask me to provide a logical explanation as to the reasoning of these self-important ass hats lol

They've been selectively enforcing their rules for decades and I'm glad to see them fading into oblivion.

On a sobering note, that's one more step closer to professional college sports free of any rules or regulations.

But on a cheerful note, the sport was always headed there, so really, what's the difference? The NCAA tried to spank Tennessee but looks like ol' Smokey's gonna be the one doing the whupping.

Perhaps now NCAA can get out of the "rules" business and focus on hosting the basketball tourney and being a professional league for Referee training and qualification.

Totally agree. I’m fine with them taking over the logistics side of big time athletics. Referee qualification / assignment. Get that out of the SEC office.

“For the reasons provided herein, Plaintiffs’ Motion for Preliminary Injunction is granted,” the decision said. “It is hereby ordered that, effective immediately, Defendant NCAA; its servants, agents, and employees; and all persons in active conce11 or participation with the NCAA, are restrained and enjoined from enforcing the NCAA Interim NIL Policy, the NCAA Bylaws, or any other authority to the extent such authority prohibits student-athletes from negotiating compensation for NIL with any third-party entity, including but not limited to boosters or a collective of boosters, until a full and final decision on the merits in the instant action.

“It is further ordered that, effective immediately, the NCAA is restrained and enjoined from enforcing the Rule of Restitution as applied to the foregoing NIL activities until a full and final decision on the merits in the instant action.”

Let's add this to the talking points with recruits. Tennessee was one of only two schools willing to file a lawsuit against the NCAA to protect the rights of student athletes.
Why you small-time thinker, you! Generate national by putting on billboards in states we regularly recruit, and renting trucks driving through campuses the following: The Tennessee Volunteers stood at the bridge to guard your NIL Rights. Use A.I. to create 4-5 generic Vols players with shields and swords in defiant poses on a drawbridge over disturbed waters, with NCAA spelled murkily in the water. Go for the gusto, or don't go at all.

Hopefully, potential recruits see this and opt to play for UT.

When the ncaa came to campus and told our administration they were being investigated for loss of institutional control bet they didn’t expect less than a month later they were the institution that would lose control.

Hats off to Donde and Danny. This is what competent leadership looks like.

Can someone break down what this means for the NCAA case and for Tennessee moving forward? More cases to come or does the NCAA back off?
Right now NCCA has to back off, at this point they have no jurisdiction on the nil. In the event they appeal and win in the appeal they cannot penalize anyone for what they have done previously. A total win by UT. We need to use in recruiting, we are the only school in the sec that went to bat for the students, Va. is the only other state who joined in with Tn. All the others had a chance to do so, but did not.

Step 1 was successful. Now, we have to continue fighting the NCAA if they do not drop the investigation.

From the linked article:

"The injunction was granted in the Eastern Tennessee District by Judge Clifton Corker, who found that NIL rules caused irreparable damage to athletes.

"In an apparent attempt to prohibit those (recruiting) inducements, the NCAA issued guidance classifying NIL collectives as 'boosters' to prevent them from negotiating with student-athletes during the recruiting and transfer processes," Corker said in his decision. "The NCAA's prohibition likely violates federal antitrust law and harms student-athletes. "Accordingly, (plaintiffs) are entitled to a preliminary injunction enjoining enforcement of the NCAA's 'NIL-recruiting ban.'""

There are no federal court sources.
Tennessee was never not going to win once the NCAA admitted they didn't know their own rules and that the ones they do know do cause harm.
he was claiming his legal sources were advising him that.....not federal court sources

I don't think they have anything to investigate, NCCA has no jurisdiction over the nil at this time

The rest of the SEC can go F themselves.

You can bet more states are lining up as we speak. The NCAA lawyers are going to be really busy. If they have any sense, they will end the UT investigation and end this NIL charade now and cut their losses.

The people running the NCAA are just stupid. Now they really lost their enforcement ability by being petty. Their selective enforcement and investigations backfired on them big time.
The attitude of the NCAA is typical of organizations that gain control or power without really working to earn it. They forced this when the investigators came to Knoxville to powerplay Plowman, then went back and leaked the "big story" to Forde. They got what they deserve. The Dept of Motor Vehicles has more respect now.
