The general USC debate thread (merged)

Ed O' Bannon will be one very rich man as he will see this as a weakness in the NCAA armor and will get what he deserves: getting paid for the use of his image in any commercial, in any way. This will open up a tidal wave of more former college players to get paid for the use of their likeness. The outcome will be a very expensive consequence.

This will teach the NCAA for being too lax on punishment on things like USC, if nothing happens to them.

This I am actually looking forward to.

Have you heard about the Nebraska QB, Sam Keller, who is suing the NCAA for letting EA use his likeness in the games? Here's a link. It's a kind of old article, actually pretty old, so I don't know if it has been resolved yet or not.

I think that law suit is still in the making. IMO it's completely worthwhile. Anybody ought to be compensated if somebody is profiting of their likeness. That's a different topic though. Please start a new thread or dig up an old one on the same issue.

Wasn't really curious enough to pursue it that much lol.

It's just the Ed O'Bannon thing reminded me of it.

Litigation and enforcement are two wholly separate things. O'Bannon will get exactly what he is legally entitled to, which is jack squat.

The 'AA only gave EA license to the logos and attendant peripheral marks. They didn't give them anything related to specific individuals. Keller's only action is against EA and it's a straight up loser.

But Ed O' Bannon's case WILL NOT and exposed what the NCAA is about in governing collegiate sports.

This post is outright totally irresponsible.

I would have to disagree as well. It is just unethical to not let the players benefit from their image under their amateur status and yet the NCAA can.

If a player feels like they are getting a poor bargain, they are perfectly welcome not to play in college. It's not like they are conscripted.

This is true, but I'm pretty sure that's not what the NCAA is about. Let us benefit from your image or don't play at all is not the message they portray to college prospects.

The NCAA is about bs and nothing more.

This is also true. And it's sad that they can just get away with it. They not being governed by an outside body is a double edged sword.

On one side, they can't prove anything in the USC case because they have no power to make any of the offenders speak, or be truthful when they do.

On the other, they are not held to any standard to follow their own rules because there is no one to enforce them.

Oh well.

The problem goes deeper than that, IMO. The Reggie Bush deposition suit being a prime example. As long as the NCAA has no subpoena powers, they can't prove the critical elements in cases such as this one. Thus all of the bs "selective enforcement" if you will.

That's essentially what I was getting at.

But I don't think they should have the power to do it though. They need an outside governing body. Because if they solely had the power it would be abused. Also, I think the NCAA should be held accountable by someone as well.

Wouldn't hurt if they had someone watching over them, IMO. But who would do it?

That is a good question and frankly I don't know.

That's the main problem to my idea. I just know that given the power the NCAA would abuse the s*** out of it. But, they do need some sort of power if the plan to enforce their rules with these shady people.

They are going to have to roll what they have. If they have not done it yet, talk to the writer who broke the story on Yahoo! Sports. They may have to talk to Reggie's parents if nothing has been done to prevent them from talking.

The 'AA has no power to force Bush's parents to talk. They'll laugh in the investigators' faces.

This is pretty laughable... I doubt the writer can give them more, and Bush's parents certainly won't do anything about it.

The NCAA will still rule..They wanted to also read Bush's deposition, but they can still issue a ruling on what they've found to date
