Trump Must Pay Half a Billion Dollars Before He Can Appeal New York Decision​


Former President Donald Trump must pay nearly half a billion dollars as a bond to New York State before he can appeal the ruling by Judge Arthur Engoron last week that he must pay $354 million in fines — over $450 million, with interest — for fraud.

Critics have noted that Trump is the only person to be sued under an obscure New York fraud statue that does not require any harm to be done, and that effectively criminalizes the everyday practice of real estate valuations in negotiations with banks.

Though Attorney General Letitia James — who ran for office promising to target Trump — claimed that no one is above the law, her case against Trump marks the only such case in the history of the state. And the staggering fine is likewise unprecedented.


Everyday practice doesn't include creating fake income statements to give to appraisers, lying about the size, or double counting revenue....

Everyday practice is finding independent, aggressive valuations with lofty projections.

I stand behind the so-called lawfare against Trump. He should not be allowed to run for President. He tried to overthrow the government. Period.
 
I'm not an attorney but I've been part of enough business/tax trials to know that clear, Statutory language dominates. The Statutory language at issue here clearly just requires a repeated pattern of fraudulent acts and not actual damages. The judge didn't have to pull a 40 year case to get there, it's just additional support for appeals.

This youtube lawyer pretty much avoids that discussion in the 25 mins I watched. I'll let @ClearwaterVol, @evillawyer or @RockyTop85 weigh in if the actual statute matters.

I do have significant issues with the judge's penalty calculations. In short, some of the evidence the judge relied on to show a repeated pattern also show the penalty proposed by the state's expert was BS. Trump's side did a poor job in fighting that but a basic common sense smell test should have been applied there...
I don’t know anything about New York law and wasn’t about to watch a two hour video.

My only thoughts on the NY Civil case has been that there doesn’t have to be a victim. I assumed that argument had been presented as a prudential argument/evidence of politicization rather than a legal argument.

Looking at it in a legal framework:
The statute doesn’t appear to require an injured party.
The constitution doesn’t prohibit victimless crimes, I can’t imagine there’s any restriction on non-criminal sanctions for conduct that could but has not yet caused any harm, when there is a legitimate state interest in prohibiting the conduct.
There may be some creative constitutional arguments, state constitutional arguments, or statutory/common law arguments that I’m not aware of. If I had the inclination to spend 24 hours riling those things out, YouTube would not make the cut for how I would use my time (although this guy went to a decent school, seems not to have appeared on infowars, and is barred in the same state so he’s a big improvement over some of the others, on paper).
There are constitutional limits on fines and punitive damages but I’ve stayed out of arguing about whether any of the ones levied against Trump will be reduced because I don’t have anything more than a vague opinion.
 
One more thing. Trump's legal team missed the filings to get a jury trial here....
That's the biggest F-up ever. I can't believe his lawyer screwed that up. Even in NY she would have been able to potentially land a Trumper to blow this up. I wonder if it's ground for tossing bc of competent council? I admit in advance I don't know if that's applicable here. But good god

This one is a little different than Carroll assault since it involved fraud so there was debate whether judge would have granted it.

But yeah, you file motion for jury trial, litigate that motion, appeal that motion, and have it as part of your appeal.

You are doing this, at a minimum, as a delay tactic...

Habba was thinking that they did check the box for a jury trial but they never did

Trump doesn't have a pristine history of paying his debts. Certainly has failed with start-ups
Paying contractors, and paying banks, are two different things.

The Banks likely had a good idea as to what his liquidity was, in addition to what the accurate valuations on his properties were

Agree but he was giving a personal guarantee and no bank would know the valuation of hundreds of JVs and LLCs all over the world. Yes, they know know the big stuff but this isn't a guy with one or two assets in a town asking for a refi...

I have no doubt the Banks knew who they were dealing with, and what he was bringing to the table.

We have an American populace where 30% look at Trump as the answer.....that's a national malignancy.
Until it is properly addressed, everything else is kind of secondary.

It didn't but it makes your "objective truth" post laughable bs. Trump voters cheered the idea he wanted his opponents locked up. He didn't do it because they were friends but he knew the ignorant would eat it up. How many times did you chant it?
