Not to derail the thread, but I heard a podcast host posit this interesting thought that was derived from Justice Breyer’s new book: maybe we just shouldn’t incorporate unenumerated rights to the states (my paraphrased version). Then let them hash those things out democratically. The catch was that the right to bear arms outside the home for self defense would be considered an unenumerated right.Would it be accurate to summarize your political stance on abortion as: the federal government simply shouldn't be involved in a medical procedure.
The next episode of the podcast had Akil Amar as a guest and he pretty much annihilated that theory as being viable at least as to guns.
But I thought it was interesting in the abstract as a way to loosen federal control and lower the stakes in federal elections.
