Maybe not but you don't have the right to physically assault someone standing in the road even if they have a gun, especially if they are not threatening you with it. Simply having a gun on you even when you are confronting someone isn't in itself threatening them with the gun.Granted. But if you've pursued a pedestrian in your vehicle, and then climb out of that vehicle toting a shotgun while that pedestrian is coming toward you, at the bare minimum you have created a situation wherein the other would reasonably fear for his life. Period. Georgia is a Stand Your Ground state. The victim was under no duty to retreat.

So the guys didn't create the entire situation by grabbing guns and trying to do the police's jobs? Did the deceased make a bad decision? Yes. Was his decision directly influenced by the unlawful action of the two men? Yes.So he wasnt assaulted and attacked? Punched and the guy tried to steal his gun?

Exactly. I always hear people say they will drag the guy three or four times over their threshold so it looks like he might have been shot inside. I don’t know Georgia’s law for confronting someone over a theft or supposed theft but I do know ours TN and They would most definitely be going in front of the grand jury. It’s not ok to shot people over property any time.When he was shot? I seriously doubt it since he chased him down a while in his truck. And even if he was, I'm pretty sure it doesn't count if you run down the guy and force him back to your property.
