I have looked into ongoing constructions when we were looking to buy a house and never thought of it as breaking the law. Not saying he was house searching, and it’s awfully suspicious if there was a theft at this property the days before. And no need to take off running after being spotted if just simply checking out a new construction. But just can’t see it being considered burglary without something being taken.
What I am challenging is this Arbery situation of being "hunted down" by 2 white males as being normal for black people and how this is something they face every time they leave their house. That is a patently false statement and statistics back that up.
With that being said, I'm not all trying to dismiss what happened here. He was murdered by 2 idiots who deserve the death penalty. I am simply upset at the narrative that this is anything beyond a tragic tragic death that didn't have to happen.....much the same with Christian and Newsome and alot more deaths that go unnoticed as well.

In Georgia, if a death occurs during the commission of any other felony, it is automatically felony murder.
O.C.G.A. 16-5-1 (2010)
16-5-1. Murder; felony murder
(a) A person commits the offense of murder when he unlawfully and with malice aforethought, either express or implied, causes the death of another human being.
(b) Express malice is that deliberate intention unlawfully to take the life of another human being which is manifested by external circumstances capable of proof. Malice shall be implied where no considerable provocation appears and where all the circumstances of the killing show an abandoned and malignant heart.
(c) A person also commits the offense of murder when, in the commission of a felony, he causes the death of another human being irrespective of malice.
(d) A person convicted of the offense of murder shall be punished by death, by imprisonment for life without parole, or by imprisonment for life.
