I could see trespassing, maybe. But I don’t see the argument of burglary without proof of him stealing.

I have looked into ongoing constructions when we were looking to buy a house and never thought of it as breaking the law. Not saying he was house searching, and it’s awfully suspicious if there was a theft at this property the days before. And no need to take off running after being spotted if just simply checking out a new construction. But just can’t see it being considered burglary without something being taken.

If you came home from the store and a stranger was inside your house, what would you infer his intent to be?
 
Off-topic, but does every state have a bureau of investigation? I'm not sure I've heard of it in other places, but I've heard about it in GA on many occasions.

And back on topic, why would the county impede surveillance footage that can exonerate (or at least calm things down) the McMichaels?

What I am challenging is this Arbery situation of being "hunted down" by 2 white males as being normal for black people and how this is something they face every time they leave their house. That is a patently false statement and statistics back that up.

With that being said, I'm not all trying to dismiss what happened here. He was murdered by 2 idiots who deserve the death penalty. I am simply upset at the narrative that this is anything beyond a tragic tragic death that didn't have to happen.....much the same with Christian and Newsome and alot more deaths that go unnoticed as well.

I think we all know that was gruesome and even difficult to want to go through discussing the details because it was so evil. It makes me angry thinking about the retards that committed the offenses. Those should've all been life sentences and anyone 18 or older should've gotten the needle though I think either happened.

I would absolutely assume he was there to take something. I’m guessing this kid was up to no good as well. Not trying to argue you there. Just can’t see a court or judge finding someone of burglary for walking into a new construction without proof of them taking something.

But what I just described to you is burglary whether they actually take something or not. Happens everyday. If you are drunk and stumble into an unlocked door of wrong apt. That is burglary. It’s the act of being inside a dwelling (or car) without Legal reason to be there

I wouldn’t wear that to go jogging

I've seen the video and to me it is not very clear. Some social media sites are saying he was wearing Timberlands, but that was shown to be false. I'm just wondering what he had on. I'm not victim blaming, but if he is wearing regular street clothes, that would poke a hole in the story about him being out jogging.

That still doesn't mean you round up a posse and shoot him down in the street, either.

To steal something... or, did someone in the house let him in and the owner not know about it?

Sounds like you are suggesting something that I haven't heard yet... that he was actually in a home? Link?

Interesting. The DA in the Amber Geiger trial should have charged her with burglary... she might have gotten more jail time.

Or, if Texas law is the same as Georgia law, felony murder.


In Georgia, if a death occurs during the commission of any other felony, it is automatically felony murder.

O.C.G.A. 16-5-1 (2010)
16-5-1. Murder; felony murder

(a) A person commits the offense of murder when he unlawfully and with malice aforethought, either express or implied, causes the death of another human being.

(b) Express malice is that deliberate intention unlawfully to take the life of another human being which is manifested by external circumstances capable of proof. Malice shall be implied where no considerable provocation appears and where all the circumstances of the killing show an abandoned and malignant heart.

(c) A person also commits the offense of murder when, in the commission of a felony, he causes the death of another human being irrespective of malice.

(d) A person convicted of the offense of murder shall be punished by death, by imprisonment for life without parole, or by imprisonment for life.
