There's not a penalty to harsh for PSU!

You guys are arguing about the wrong body of who may or may no inflict any punishment. The DOE is who is gonna do the majority of the punishing and yes this will lead to innocent people not getting loans and grants, thus will inflict more harm then anything the NCAA could do.

State DOE? I'm skeptical, they are too connected, imo. But, I would be interested to hear what you think they could do to punish the school.

The way I read it..........not a lawyer, but the way it is laid out in section 19 is that they are specifically referring to violations of established rules........thats just the way I read it.

exactly. It's an explanation as to why the rules will be enforced.

The Federal DOE. Stafford loans, pell grants, etc go through them and they have without a doubt a case and the power to do so.

So there is no expectation of moral or ethical behavior inherent in the bylaws of the NCAA except as it applies to previous infractions? If this is indeed the case the rulebook needs some serious additions.

I highly doubt the DOE will get involved and effectively punish an entire body of students that had absolutely nothing to do with this.

someone put it earlier that it's that the NCAA is pretty much the only group that some/many of these people are familiar with as any type of enforcement agency with regards to university

They may not, but what good is a law without the backbone to uphold it

Clery Act is a Federal Law and Penn State absolutely violated it.
 
I think they can and should fine PSU, but I dont know if I would agree with them suspending the SFA programs there.....that only hurts the student imo

The HFC and AD convinced the Pres to sweep this under the rug. To the extent that was done to protect the FB program it may fall under NCAA jurisdiction.

Given that the FB program was at the core of this horrible scandal, I can see PSU voluntarily or being forced by some entity to cease FB operations for some period of time to do a massive review and reflection of where it should fit within the greater mission of the university.

I don't see that happening, but leverage could be made to force PSUs hand on leveling sanctions on its FB program

You're right. Moral and ethical behavior by the member institutions most cerrainly fall under this rule. Others may not like it but it is what it is.
