It's listed with enforcement policies and procedures, not with violations. If they had meant for it to be a violation, they would have listed it with the violations.
Almost EVERY member organization has a "character" clause. If the NCAA want to do something this could very easily be used.

Vacate wins going back to '98. Give Spanier, Shultz and Curley show cause bans preventing them from being hired at NCAA institutions. Just for starters.
Siap but watching joe schad on otl and he's saying that there's basically nothing the NCAA can do to penn state.
Character clauses are generally used to terminate individuals who do wrong. The individuals who did wrong in this case have already been terminated, and the NCAA never had authority over most of them to begin with.
Almost ALL professional membership organizations have character clauses for protection of the org, reasons for expulsion and for punishment.

Right, so the NCAA could (arguably) force out Paterno and Curley for their roles in this and slap show cause orders on them. But character clauses don't apply to businesses as a whole.
This makes me wonder about about something. For instance...it is not enough that Tennessee has a drug policy, they must according to the NCAA, follow it. So, if a player was supposed to serve a suspension and did not, the NCAA would have a reason to get involved, because the school did not follow it's own policy.
In the case of Penn State, they had the Clary Act in place, the procedure for reporting crimes and they did not follow it, further, the football staff was completely unaware of it. So, Officials at Penn State did not train their employees in regards to this OR the employees ignored their superiors. Isn't that reason enough for the NCAA to be involved?
