It's listed with enforcement policies and procedures, not with violations. If they had meant for it to be a violation, they would have listed it with the violations.

Almost EVERY member organization has a "character" clause. If the NCAA want to do something this could very easily be used.

IMO, I would heavily consider destroying anything associated with PSU football and even consider cancelling the 2012 NCAA football season altogether.

Character clauses are generally used to terminate individuals who do wrong. The individuals who did wrong in this case have already been terminated, and the NCAA never had authority over most of them to begin with.
 
Vacate wins going back to '98. Give Spanier, Shultz and Curley show cause bans preventing them from being hired at NCAA institutions. Just for starters.

The NCAA has no authority over Spanier or Shultz, as they weren't involved in athletics. The NCAA cannot issue show cause orders for non-athletics staff members.

That said, it won't really matter because they will be in prison.
 
Siap but watching joe schad on otl and he's saying that there's basically nothing the NCAA can do to penn state.

Yeah schad's been the analyst/reporter they've had reach and speak to former members and lawyers of the NCAA.

Isnt Spanier still employed and tenured at PSU?

Almost ALL professional membership organizations have character clauses for protection of the org, reasons for expulsion and for punishment.

Right, so the NCAA could (arguably) force out Paterno and Curley for their roles in this and slap show cause orders on them. But character clauses don't apply to businesses as a whole.

This makes me wonder about about something. For instance...it is not enough that Tennessee has a drug policy, they must according to the NCAA, follow it. So, if a player was supposed to serve a suspension and did not, the NCAA would have a reason to get involved, because the school did not follow it's own policy.

In the case of Penn State, they had the Clary Act in place, the procedure for reporting crimes and they did not follow it, further, the football staff was completely unaware of it. So, Officials at Penn State did not train their employees in regards to this OR the employees ignored their superiors. Isn't that reason enough for the NCAA to be involved?

I mean, if the janitors are afraid to report to their superiors, the president is misleading the BOT and the head coach is telling his superiors how to handle the Sandusky situation and THEY go along...

The NCAA actually has drug/PED rules on the books. They are convoluted, and way too much is left up to the schools and/or conferences, but the rules are there.

There are no rules regarding criminal behavior. The NCAA has nothing in its bylaws that is reflective of the Clery Act, so the NCAA cannot force its members to comply with it.

But the university is the member not the individual and that's my point. I guarantee you an org as big as NCAA has a way to punish/expel any member for almost any reason they want. The usual catch all is the character clause. Will they use it? Who knows but they could.

Of all the things that could happen within an athletic program, this is like 1000x worse than phone calls, paying broke students, or covering up for players who got paid by outside sources. They let KIDS get RAPED over and over for 14 years and set up a cover up system that even helped keep it going. Even if they covered up the first ones and faded dude out into exile I would have felt a little better. Criminal charges should be handed out and also PSU should get the death penaty in athletics, and funding pulled from whatever sources they were getting. Make them into the Pennsylvania version of Vol State.
