I hear what your saying. But I wouldnt blame a young man trying to do the right thing for the actions of reporters who make more news than they report.

My whole problem with this is: He's facing some tribulations and he's bolting. Pissing away an opportunity and running back to his home state. Did he scorn Tennessee initially? I would like to see the air cleared before something is shoved down our throats.

If he is exonerated I have no problem letting the guy come here after he is exonerated, but would be irresponsible until we have more info. Especially with the Hood story, we don't want to get that reputation.

I don't ever believe rape accusations unless there is absolute and total proof.

I will say this. Throwing some bedsheets and underwear in a paper bag and shipping it off to the lab means very little in a case like this. Forensically speaking, finding fluids of any kind does not mean he raped her. It means there was sexual contact of some kind. Consent, or lack thereof can only be established through a combination of victim/subject/witness interviews and, if done in a timely manner, a physical examination of the accuser.

According to the laws of date rape in the state of Tennessee, many of the guys I was friends with were raped during college.

If you are so drunk that you do not know what you are doing, and you wake up the next day and regret your actions and say that you were so intoxicated that you could not make a decision the previous night, it can qualify as date rape.

I have never heard of a guy falsely or truthfully accusing a girl of rape in this manner, but under the law he could. That is why drunken hook ups with random chicks are such a bad idea.

But, I want to point out to you that this kid was a STARTER on one of the best offenses in the NCAA. He left and Gundy let him leave. Am I reading too much into it? I don't know.

You're absolutely right. Any physical evidence found becomes significant if he denies having touched her. Not sure what he said to the cops when interviewed. If the reports that are circulating are true, and she is the daughter of someone important, Gundy may not have had much choice. If he is indeed trying to help the kid, it may be because he knows more than we do.

You may be right but if this woman who accused him of rape is the daughter of the booster he may have played a role in getting Gundy to let him leave so easily and get him out of town. In fact he may have been told by Gundy if he didn't leave the team he was going to get kicked off. There's a lot of IF's in this story, so I'll be interested in finding out the facts later on.

This is a very unfortunate situation. Only a handful (maybe two) know what really happened and perhaps he's guilty. But I will say this:

Occasionally, in college "rape" scenarios, a girl gets too intoxicated and does not want to deal w/ the reality that she made a bad decision on her own. Now, of course, there are unfortunately times when unconsented sex does occur, which is text book rape, and charges are justified. However, I have a feeling this situation is not such.

I have no idea whether it's true or not, but if this girl pressed charges b/c her father (one of OSUÂ’s biggest boosters) found out she was seeing a black athlete than I would expect the truth to come out eventually.

I am not on either side, as I have no idea except what I've read on the internet (which is usually not a good source for anything, especially in alleged crimes). Nevertheless, having graduated from college and having experienced the "party scene", I knew a few situations were guys who didn't need to force or take unwanted sex from a female would get into potential "rape" scenarios w/ freshmen girls who were new to heavy drinking or promiscuous women who were in self-denial w/ their sexual advances with alcohol being the common denominator. ThatÂ’s why men should always tape their sex lives (ok, ok, IÂ’m just joking w/ that last line, sheesh!)Â….

I see what your saying and I appreciate your argument. What annoys me is this mini story just thrown out there with absolutely no regard for the impact it may have on the lives of the people involved.

Problem is, buddy, you're talking about 99% of sexual relationships in college that aren't in the boyfriend/girlfriend category. I know that date rape is a touchy subject and I don't want to upset anybody but the way men are subjected to date rape charges is completely unfair. I believe you're making this point more tactifully than I b/c you said most of your male friends have been in this drunken hookup/date rape situation, which I can say the same for my friends (and perhaps myself).

Anyway, if a woman consents to a sexual relationship while intoxicated, unless she is already passed out or to the point of not being coherent or moving, it should not be "rape" of any kind. I can't believe how a guy can have his reputation ruined by accusations of this without any evidence. It's shameful b/c rape is a very serious crime that should be dealt w/ harshly. "Date rape" does occur but I suspect, more often than not, the definition you listed is what really occured.

I'm probably going to get blasted by most bloggers for this but that's ok. I stand by what I say to anyone and everyone.

So in other words... assume he is guilty until proven innocent??? I agree we should tread lightly, but there is much that can be found out before waiting for exoneration.

Two sides to every story. She admits she was so drunk she passed out several times, making her entire charges questionable at best. Let's hear his side of the story. Like most stories, the truth most likely lies somewhere in the middle.
 
The girl's name is Kayla Starks. Her dad is Ken Starks president of BancFirst in Stillwater and a big time booster. For what it's worth here is the link to OrangePower's thread about Mosley. Pretty interesting posts.
