Do you know the law in TN about an Open Container?

The Law as I have understood it, unles changed in the last year or so, is that there is no "Open Container" law in the state of Tennessee. I had heard this from friends many times and didn't believe them and asked a state trooper if this was true. This was like 3 years ago but he said as long as the drink isn't possessible by the driver than the passengers and can drink. But I also believe the driver has to blow a .00 on a Breathalizer for him not to be charged with open container I believe. And if there were 4 open beers and 4 passengers... well then the math is against them also...

They didn't give Tatum a breathalyzer test did they? If so, does it really matter that they had an open container in the car, as long as he wasn't drinking? Aren't they all 21 or older?

Tatum was driving and was cited for open container. Since there were other passengers in the car that could have easily said (Naw man, that's mine.) it's pretty certain they determined he'd been drinking or he simply admitted to it. For informational purposes:

(C) A motor vehicle is in operation if its engine is operating, whether or not the motor vehicle is moving.

(b) (1) A violation of this section is a Class C misdemeanor, punishable by fine only.

(2) For a violation of this section, a law enforcement officer shall issue a citation in lieu of continued custody, unless the offender refuses to sign and accept the citation, as provided in § 40-7-118.

(c) The provisions of this section shall not be construed to prohibit any municipality, by ordinance, or any county, by resolution, from prohibiting the passengers in a motor vehicle from consuming or possessing an alcoholic beverage or beer in an open container during the operation of such vehicle by its driver, or be construed to limit the penalties authorized by law for violation of such an ordinance or resolution. From my understanding of the situation, none of the players claimed any of the substances, so if the passengers don't claim it, they can charge the driver. Doesn't mean he actually consumed any of it.

I'm not hearing that Tyler is gone. APR stands in the way.

Like I said, that was coming from a guy off Volquest, so i'm not 100% sure myself. But did you also see that Hubbs said that all stuff with Tyler's picture on it has/will be taken down.....from billboards to programs and whatever else.....That probably says something as well.

Can we lay off Tyler Smith please? He may not have made the best decisions in his life but he lost his father and has done his best to support his child. By knocking him, you're basically saying you care more about him hurting Tennessee basketball than you do his life. How messed up is that?

I lost my father. I'm doing a great job supporting my children, and I did the right thing and married my childrens' mother. I'm not in possession of an altered firearm, or marijuana. I'll knock him all I want because he made stupid decisions knowing that they were stupid decisions before he made them. And actually all that I do care about is him hurting Tennessee because right now I'm embarrassed of my diploma hanging in my office.

You don't need an excuse to have a gun in Knoxville or Memphis.

Check out the murder rates. Some of the highest in the country.

Either way, having a gun with numbers scratched off is what I'd call a mistake. Are you saying you're mad at him for hurting the basketball team? I'd be more mad at him if he ditched his son.

Life > basketball. It's a game.

You need a life if you care about how this affects your diploma. One person is affecting your life that you've never met. Sad dude.

Since when does having a gun make you a bad person?

Pot and alcohol... who cares. He is a college student.

Having a gun with the serial number filed off typically makes you a shady character.

If he didn't have a kid, I could buy the second argument, but T. Smith is 23 or 24 yrs old with a child that's 2 or 3. The level of responsibility for him is much higher than a typical college student.

Knoxville is no worse than any other city of comparable size as long as you aren't walking alone in Fort Sanders at 2:00 AM.

Of course, anyone who is dumb enough to do that probably deserves anything they get.

I understand how bad the numbers being scratched off looks but it's a mistake none the less. It's not like he has ever harmed anyone. You can't just assume he was going to. Maybe he would have, maybe he wouldn't have.

All I'm saying is that we should hope this guy turns his life around instead of trashing him. I consider Tennessee a family. You're a pretty crappy family if you turn your back on someone when they aren't doing anything for you.

In other words, some of you were basically using him. He was nothing but a tool. That's terrible. Everybody has different problems and reacts to those problems in a different way. The guy is a human being. Just throwing dirt on him doesn't really make anyone better than him. Especially if they claim to be christian.
