What do you think has been said in an Omega Psi Phi party over the years?

Nasty stuff, but none worthy of expulsion. Just as this isn't.
 
The difference between these "racist idiots" and "racist idiots " like Sharpton and Farrakhan, etc. is what? Well, these guys are young, probably drunk, and trying to act in an outrageous way around their friends like young males often do, and they thought that they were doing it in private.

Sharpton, etc, are adults who make a living intentionally being racists. What consequences do they suffer?

It's unfortunate that Sharpton, Jackson, Farrakhan, et al suffer no consequences for their actions.

But are you suggesting that because SOME racist idiots have suffered no consequences, ALL racist idiots should get free passes? Do you think that ALL muderers should get a free pass because OJ Simpson wasn't convicted?

My college stupidity never included open declarations that I would sooner murder a black man than associate with him.
I wouldn't call it an "open declaration" unless they knew that the tape would be made public. Even drunk college students aren't that stupid.

Nobody is saying they shouldn't or haven't already faced consequences. Having their names already tied to this incident is certainly going to stay with them for as long as google searches exist

As long as they're interested in making themselves radioactive to all potential employers, suing for your right to be a racist idiot is a swell idea.

Only morons twist it that way. It's suing for your right to do what you want in privacy without a gov't institution interfering in that. And if they're punishing them for it, they're interfering with their rights to do so.

It's irrelevant how you claim to have acted in college.

What's not is that fact that rational, thoughtful people recognize that college kids do and say very stupid things that they will likely regret.

Again, i don't defend what they said or how they acted, but I also don't think it's grounds for expulsion

O.J. was innocent. Football stars don't commit crimes. They are beyond reproach, especially if they are on your team.

On a more serious note, Sharpton has been responsible for deaths, injuries, and millions of dollars in physical damage to various cities. These guys said something stupid, and didn't expect it to get out.

The faculty is employed by whom? Their checks are paid by whom? They are being kicked out of school because they said something that people didn't like.

If you work for the State of Tennessee, and you get filmed saying something horribly racist while away from the office, the State absolutely has the right to fire you.

The First Amendment only protects you from being sent to prison, fined, executed, or deported for exercising your right to free speech. It does not guarantee you college admission or employment.

Well it only took a day. Two people expelled from a public university without due process for saying the n-word. I'd say that qualifies as a 1st amendment violation or at least that's the way I remember it when I was sitting in Con Law as a 1L with all the other racist frat rats.

You obviously wasted money on that class because you didn't learn anything.

Not really a good analogy; you're talking about an individual act compared to a bus full of people.

A better comparison would probably be what Duke lacrosse was accused of, and they basically did disband the team even though the accusations had zero substance.
You could fill up a bus with U.T. football players accused of sexual assaults in Knoxville.

I dont think that has relevance because no one here or abroad (that Im aware of) have condoned or claimed that it wasnt stupid or hurtful.

I am 100% against what they said, and am fine with repercussions. Just not those particular ones imposed.

One case you're being paid to represent an institution, the other case you're paying. If I'm giving $20k a year I expect to be able to say whatever the hell I want in an off campus setting.

If you work for the State of Tennessee the state signs your paycheck. Students aren't on payroll.

Unless you can point to the Article that guarantees a college education at the public school of one's choice.
