The point here, which should be obvious, is that everyone needs to exercise sound judgment and self-control, even when acting in what s/he
believes to be a good way. You can't kill somebody because of what he /might do./ You can intervene to subdue someone who is
acting erratically or in a threatening manner--but you don't keep choking him for an extended period of time until he dies. It shouldn't have
been that difficult for him and a couple of other male passengers to hold the man down until the police arrived.
 
Certainly should take more than being yelled at, there is nothing to “protect yourself” from in that scenario
You're not being genuine with the situation. That's why he said you were trolling. If someone is making violent threats, I would take the person at face value. I'm not waiting around to protect myself if I perceive a threat meets a certain level for action.

Plenty of people in this thread have said we're better off without him etc. People really want to side with the guy who choked someone out for 15 minutes and their best argument is "he might have gone from someone who physically attacked 0 people into a murderer if the hero didn't choke him out for 15 minutes"

I will openly say that I wished Mr Neely hadn't died. I dont know all the circumstances that contributed to this, but here is what I know (at least what was reported).....there were 2 other bystanders that helped restrain him. That leads me to believe there were others that perceived the threat similar to what Mr Penny did. Also, another person that did not take action, that was questioned by the police called him a hero for the action he took. Mr Penny wasn't out there on a fringe with his perception of danger to himself or others around him. Did he go too far? Maybe/Maybe not.

Under the regulation, she said, New York public health authorities “could have removed you from your home with the force of police and put you into a detention facility of their choosing.”

“You had no say where you went and they could have held you there — or locked you in your house — for days, for weeks or months. There was no time restriction in that regulation.

“And they could have done this not just to you, but they could have done this to your child or your grandchild or your elderly parent. There was no age restriction in that regulation.

“There was no way for you to get out once they put you in there, meaning there wasn’t a procedure built into the regulation that said, for example, you can take a test so you could prove that you don’t have COVID or that you don’t have tuberculosis or whatever other disease is on their list.”

I don't know whether he 'deserved' to die or not. I honestly don't GAF that he did any more than he would if I was dead. He wasn't anybody special. None of us are.

I think he was still alive when the emt’s got there. Did Penny cause his death or did he cause his on death by his actions? Did they do a tox screen on him? If he was on fentanyl, it could have help cause his death.

I don’t want anyone to die but there’s a lot about this case that we don’t know.

What about the people on the subway that shouldn’t have to worry about being attacked? Where’s the cops. They can’t do their jobs because they’re afraid of being charged. And, when they lock someone up, they’re released. This guy had been picked up quite a few times and I think he was on a most dangerous list if I’m not mistaken.

Most of the passengers called Penny a hero and thanked him for protecting them. Penny shouldn’t have had to be in that situation. There should have been cops there and this would never have happened. But, thanks to the defund the police movement, you get what happened.

It’s bad on both sides. A person shouldn’t have lost his life and another person’s life will be ruined.
