Thoughts After Reading The Letter...

The NCAA has clear language in their rules stating that secondary violations may be deemed major if they are intentional, flagrant, and part of a pattern of noncompliance. If UT makes the argument you are advocating, they've lost their damn minds.

I guess we should start helping them look for them...

Conflicting info. That's why I'm looking for a reference to the NOA. Since there's plenty of flaming, I'm looking for the specifics.

The four day time frame would appear to be the reason that the NCAA consideration of a major violation. It would seem that coaches under this situation would have run from this kid, rather than engaging in a conversation with him. Again, a complete disregard for NCAA rules that the committee will not take lightly.

How do you know what the NCAA will and won't take lightly? Not doubting your knowledge, but unless you have sat on the Infractions Committee, how would you know this?

Come on guys. No one on here actually knows what happened with the bump incident. Our compliance people said after learning of the possible infraction that it was not a violation. Can we at least agree that there is more to the story which may be up for debate with the ncaa and have this allegation reduced or thrown out?

Great point. The masterful job the compliance department has done monitoring the actions of this basketball staff gives me great faith in their assertions.

First, since Pearl had already broken the Junior contact rule at Milwaukee, there should have been an annual letter to him about that issue. That way, if he breaks the rule, it's all on him. Second, it's obvious they essentially let the staff police their own phone contacts. Instead of doing their jobs, they acted like a bunch of starstruck children.

Good grief. Are u asking our compliance people to act differently than any other institution in the country? This is on bruce and staff not the compliance dept fault

You obviously haven't the faintest idea what the job of a compliance department is.
 
I don't think he's placing blame solely on the dept. Just pointing out their obvious shortcomings.

I would think that it being classified as a major violation would give you some hint as to how it is being considered.

Point taken. But he was merely pointing out the possibility of the allegation being reduced or thrown out thats all. Has happened plenty of times. He of course was reminded how ridiculous any attempt by ut to supply information to the contrary would be. If ut did nothing and just sat on their hands and accepted their punishment as is what would the feelings around here be?

Without flaming or being derogatory, where are reading this? If it's the NOA, please reference the section.

The cover letter to Jimmy Cheek says that every violation listed in the NOA should be considered a major violation unless it's clearly labeled a secondary. The Sept 14 bump incident is not labeled a secondary.

The COI can also ADD charges not included in the original LOA, too, IIRC.

In fact re-read the bit that says that they have not yet received all documented evidences from the investigators at this point....having only reviewed those written accounts of allegation supplied to them.

Something to consider.

So should UT not appeal because there is a chance of more charges?
